Mudford Parish Council wishes to inform residents of the outcome of the judicial review it brought in respect of Somerset Council’s planning decision for Primrose Lane (application 14/02554/OUT).
The Court dismissed the Parish Council’s claim and ordered the Council, as claimant, to pay the Defendant’s costs in the sum of £10,000 (inclusive of VAT), to be paid within 14 days. Permission to appeal the decision was refused.
At its meeting on Wednesday 20th May, the Parish Council considered the judgment and the advice received from its legal team and unanimously agreed not to pursue an appeal to the Court of Appeal.
